Visitor Visa for Cuban Family

Summary

Our client’s family, from Cuba, was refused entry to Canada for a visitors visa. We reviewed the notes from the Canadian government officer, got all of the documentation and reapplied. The application for him and the rest of the family was approved!

Background

Around the beginning of March 2018, we received a call from Rueben Gamvardella. He needed immigration help for his brother (Hector Gamvardella). Rueben booked the consultation for his brother, Hector. He explained that Hector and his family desperately needed assistance with applying for a visitor visa application. Hector and his family had all six of their applications for visitors visa and a study permit refused. Rueben really wanted his brother to visit his family, including his two small children.

Assessing The Situation

Rueben booked a consultation with one of our legal representatives. Reuben forwarded the notes from the officer of the Government of Canada. We wanted to understand why the officer made the decision to refuse all applications.

VisaPath sent a customized document checklist, created just for Hector’s situation. We immediately began working on getting the officer’s notes and assessing Hector’s situation in order for us to build arguments for the visitor visa applications.

We were able to retrieve the officer notes. They refused all his previous application because they did not believe he would exit to his home country at the end of his stay. The immigration officer did not believe the intent was genuine. All this was explained in a meeting with Rueben, Hector and the representative working on his case. We explained that with the new visitor visa application we will show supporting documentation refuting these claims given by the officer.

The VisaPath Approach

Immediately we got started on re-applying for a new visitor visa application. We received all of the required documents from Hector. Based on these documents we were able to develop compelling arguments to convince the officer that Hector intention was only to visit Canada.

We requested the visitor visa to be issued for one month. Our arguments were focused on the genuineness of the purpose of travel and emphasizing strong ties to his home country. We explained that Rueben has a close bond with his brother, their communication is constant, and that there was a special event coming up that they wanted Hector to be a part of it.

We addressed his previous refusals and emphasized that his ties to his home country was based on family he had in his home country of Cuba, his employment with supporting documentation. This included that, he had previous traveled to other countries and have not overstayed his welcome, he has always returned home at the time he was suppose too. We also mention that he has personal assets and finances in his home country that need him to be there in order to progress and that would be unreasonable for him to abandon his country. We also were able to demonstrate that he could support his stay in Canada.

The Result

The visitor visa was submitted online, on September 19, 2018. By September 30, 2018 we received a communication from Citizenship and Immigration Canada indicating a decision has been made for the visitor visa application. It was approved! As you can imagine Hector was overwhelmed with excitement, he was now able to reunite with his Rueben. Rueben informed us he wrote a Google Review recommending our firm to others who are looking for assistance for any immigration matter.
