What You Should Know About Spousal Sponsorship Application: According to IRP Regulations, a sponsor must make a formal three to ten year commitment to become financially responsible for the family members depending on the sponsorship relationship and the age of the family members being sponsored. This commitment is called an undertaking and is included in the sponsor’s application and is a legal contract with the minister of citizenship and immigration.
The basis for this requirement is two-fold. First the sponsor’s function is to ensure that relatives receive the support they need to establish themselves in Canada so they will not become a financial burden on the community and require social assistance. By signing the undertaking, the sponsor agrees to repay the Canadian government for any social assistance payments made to the sponsored family members.
The undertaking takes effect the day sponsored relative arrives into Canada. Generally the duration of the undertaking is for 3 years for a spouse.
What You Should Know About Spousal Sponsorship Application: Provide essential needs?
Essential needs refer to basic needs that an individual would need on a daily basis such as food, clothing, shelter, dental and eye care and other health needs not covered by public health services available to Canadian citizens and permanent residents.
The obligation of the sponsor to provide for the essential needs of the sponsored relatives will only arise if the sponsored relatives are unable to provide for these needs on their own.
What You Should Know About Spousal Sponsorship Application: Sponsorship Agreement
By signing the agreement, the Sponsored person also promises that she/he will make every effort to support himself/herself. The Sponsored person has a duty to not solely rely on his/her Sponsor and rather find way to earn a life for him/herself.
The agreement sets out what the responsibilities for both the Sponsor and the Sponsored are. If the Sponsored person ends up receiving Social Assistance then that money is received from the Sponsor and consider a debt owed by the Sponsor.
What You Should Know About Spousal Sponsorship Application: Conditional permanent residence
CIC introduced this assessment which requires that spouses, common law partner or conjugal partners who are in a relationship with their sponsor for less than two years and have no children at the time of sponsorship must cohabit in a conjugal relationship with their sponsor for a period of two years after the day they have arrived in Canada as a permanent resident.
This condition does not apply if the couple has been together for more than two years or have children together, or has been in a conjugal relationship for more than two years or have cohabited in a common law relationship for more than two years.
What You Should Know About Spousal Sponsorship Application: Processing Time
It is also important for couples to know that the processing time for both inland and outland sponsorship are long. It can easily take a few years for a spouse to receive permanent residence status. However, outland sponsor ship takes less processing time than inland.
